Born-Eco's Terms of Use.

These are the terms of use you agree to when using Born-Eco’s services, or creating an account with Born-Eco.

 

 

Firstly, when you make a purchase with Born-Eco you are supporting a small independent business, so thank you.

 

General.

Born-Eco is a marketplace and therefore the contract is between each individual “sellers” and the “buyer”.

Born-Eco provides a service to facilitate that contract but is not responsible for it or its fulfilmentin any way.

By using our services you adhere to these terms of use and agree to these policies and Terms of Use.

 

 

 

 

Discrimination Policy.

On Born-Eco, you can't discriminate based upon:

Race

Colour

Gender

Ethnicity

National origin

Religion

Gender identity

Sexual orientation

Disability

Any other characteristic protected under applicable law*

*It is your responsibility to know your local laws and any other legal regulations on discrimination that might apply to you.

 

Whether you’re listing items, using community spaces, or sending messages on Born-Eco, discrimination is not allowed. Examples of prohibited behaviour include, but are not limited to:

Refusal of service based on membership in one or more protected group

Derogatory or demeaning remarks against protected groups listed above

Racial slurs

Posts that support or glorify hate groups and their members

If you think discrimination has occurred, please report it by contacting us, and we will investigate. If you see a listing with us that you believe violates our Prohibited Items Policy, you can also contact us to make a complaint, and the matter will be dealt with accordingly.

Your Born-Eco account.

 

To use some of our services you’ll need to create an account with Born-eco. Here are our rules when it comes to having a Born-Eco account:

-Be honest with us.Provide accurate information about yourself. It’s prohibited to use false information or impersonate another person or company through your account.

-Choose an appropriate name.You do not have to use your name when creating your account. However, you may not use language that is offensive, vulgar, infringes someone’s intellectual property rights, or otherwise violates the Terms.

-You're responsible for your account.You’re solely responsible for any activity on your account. If you’re sharing an account with other people, then the person whose financial information is on the account will ultimately be responsible for all activity. If you’re registering as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business. Also, your accounts are not transferable.

-Protect your password.As we mentioned above, you’re solely responsible for any activity on your account, so it’s important to keep your account password secure.

Let's be clear about our relationship.These Terms don't create any agency, partnership, joint venture, employment, or franchisee relationship between you and Born-Eco.

 

 

 

 

Using our services.

 

When using Born-Eco’s services you agree to:

 

Don’t Use Our Services to Break the Law. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal, and international laws that may apply to you. For example, it’s your responsibility to obtain any permits or licenses that your shop requires; you may not sell anything that violates any laws, and you may not engage in fraud (including false claims or infringement notices), theft, anti-competitive conduct, threatening conduct, or any other unlawful acts or crimes against Born-Eco, another user, or a third party.

 

Don’t Steal Our Stuff. You agree not to crawl, scrape, or spider any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.

 

Don’t Try to Harm Our Systems. You agree not to interfere with or try to disrupt our Services, for example by distributing a virus or other harmful computer code.

 

Follow Our Trademark Policy. The name "Born-Eco" is a trademark. If you’d like to use our name or logo, please just contact by any means and ask.

 

Share Your Ideas. We love your suggestions and ideas! They can help us improve your experience and our Services.

 

 

 

Termination.

 

Termination by you:

We would hate to see you leave us! But, if you do choose to leave, you may at any time. All you have to do is head to ‘settings’ in your account dashboard and hit ‘Delete account’. By deleting your account you agree to all your content on Born-Eco also being erased.

 

Termination by us:

We may terminate or suspend your account (and any related accounts at any time, without advance notice, if we feel you are in breach to these policies. If we do so, it’s important to understand that you don’t have a contractual or legal right to continue to use our Services, for example, to sell or buy on our websites or mobile apps. Born-Eco may refuse service to anyone, at any time, for any reason.

If you, or Born-Eco terminates your account, you may lose any information associated with your account, including Your Content.

We May Discontinue the Services. Born-Eco reserves the right to change, suspend, or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you, including your income or your ability to generate revenue through the Services.

The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service ends.

 

  • In the event that you have listed items with Born-Eco and now wish to delete your account you may do so, however we ask that you also notify us. As items you listed may still appear on our website, and may still be purchasable, even after your account has been deleted.

 

 

 

 

Disputes.

If you find yourself in a dispute with another user or a third party, we encourage you to contact the other party and try to resolve the dispute. Born-Eco will attempt to help you resolve based on our interpretation of our policies. Born-Eco has no obligation to resolve any disputes.

Release of Born-Eco. You release Born-Eco from any claims, demands, and damages arising out of disputes with other users or parties.

 

 

 

 

Items You Purchase. 

 

You understand that Born-Eco does not manufacture, store, or inspect any of the items sold through our Services. The items on Born-Eco are produced, listed, and sold directly by independent sellers, so Born-Eco can't and does not make any warranties about their quality, safety, or their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release Born-Eco from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers, or items that caused physical injury (like product liability claims).

 

 

 

 

Content You Access.

 

You may come across materials that you find offensive or inappropriate while using our Services. Born-Eco is not responsible for the accuracy, copyright compliance, legality, or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.

 

 

 

Third-Party Services.

Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Facebook). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. Born-Eco is not a party to those agreements; they are solely between you and the third party.

 

 

 

 

Your Content:

 

Content that you post using our Services is your content. We don’t make any claim to it, which includes anything you post using our Services (like names, profile pictures, listings, reviews, comments, videos, usernames, blogs etc.).

 

Content:

You understand that you are solely responsible for Your Content. You represent that you have all the necessary rights to Your Content and that you’re not infringing or violating any third party’s rights by posting it.

 

By posting Your Content through our Services, you grant Born-Eco a license to use it. We don’t claim any ownership to Your Content, but we have your permission to use it to help Born-Eco function and grow.

 

By posting Your Content, you grant Born-Eco a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content. This allows us to provide the Services and to promote Born-Eco, your Born-Eco shop. You agree not to assert any moral rights or rights of publicity against us for using Your Content. You also recognise our legitimate interest in using it.

 

We reserve the right to remove listings that we determine are not within the spirit of Born-Eco. Violating this policy may result in the member's selling privileges being suspended and/or terminated.

 

 

 

 

 

Your information as a seller:

 

We only hold the data necessary to offer the services provided and help create an enjoyable experience on Born-Eco. As a seller on our website you agree to the holding of this data which may include:

-Name

-Payment information (PayPal email address)

-Contact information such as an email address

-Demographic information such as a physical address

-Information about your store (such as your store name and telephone number)

-Social media links

-Product photos, prices, and descriptions.

 

By agreeing to these terms of use you allow Born-Eco to use this information on third-party services such as online directories, to help improve your experience with us.

 

 

 

 

Fees:

Transaction Fees

Transaction fees are for customers. Born-Eco add a £0.30 transaction fee to each transaction, no matter how small or big the purchase. This fee is to allow Born-Eco to process your purchase and personal details safely and securely. By creating an account, and agreeing to these policies, you agree to this transaction fee.

 

Seller’s fees.

Currently, Born-Eco only charges a small transaction fee of 5% to cover any admin costs and costs incurred by PayPal. There is currently no other form of fee for items sold on Born-Eco. This term is applicable to items sold in 2020 and may change in subsequent years.

 

 

 

 

IP policy:

Born-Eco is a marketplace comprised of individual third-party sellers who run their own shops, create their own policies, and are responsible for their inventory, shipments, and complying with the law. We provide a venue but do not manufacture goods, keep inventory or ship items on behalf of our sellers. The content uploaded on our marketplace is generated by independent sellers who are not employees or representatives of Born-Eco. Sellers are responsible for ensuring they have all the necessary rights to their content and that they are not infringing or violating any third party’s rights by posting it.

Born-Eco reserves the right to disable any listing, shop, or account that we believe violates or policies in any way. Born-Eco can’t speak on behalf of intellectual property owners, nor is Born-Eco in a position to offer legal advice or make legal determinations whether a shop’s content infringes someone else’s intellectual property. Born-Eco will remove material cited for alleged intellectual property infringement when provided with a proper notice.

 

 

 

 

Transparency as a seller:

At Born-Eco, we value transparency. Transparency means that you honestly and accurately represent yourself, your goods, your packaging, your deliveries and your business. As a Born-Eco seller, you agree to:

Disclose in your ‘About’ section the names and roles of people who help make your items or run your business.

 

Use your own words and photographs (not stock photos) to describe your items.

 

Respond to any inquiries from us in a timely manner. For example, we may ask you how your items are made, what workspace, tools and equipment you use.

 

Using Born-Eco’s messaging system.

Members may send each other direct messages using the built-in messaging system.

By using direct messages in Born-Eco, you agree to all of the above policies. In addition, you may not send messages that are considered:

Abusive, threatening, defamatory, harassing, or otherwise in violation of our Anti-Discrimination Policy.

Obscene or vulgar.

Unsolicited advertising or promotions.

 

All sellers agree to abide by The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

This law protects the consumer when buying over the internet or by mail order and applies to all member states of the EU.

Born-Eco aims to make it easy for sellers to comply with the DSR and consumer law, however, all compliance is the responsibility of the seller.

“Made to Order” items must be clearly stated in the product description and the shipping policy.

If a seller is on holiday they are responsible for ensuring their shop is in “Vacation Mode” and clearly state in their “Vacation Message” when items purchased will be posted on their return from vacation.

 

 

 

Goods sold:

Goods that you sell must firstly be represented correctly to the customer through your OWN photos and an accurate description of said good.

Sellers must give a full list of ANY material used to make the product and the packaging. Failure to do so may lead to a sanction or a ban from Born-Eco.

When products are listed they are first sent off for review before going live onto our marketplace. By agreeing to these policies you agree to this process. Products that do not meet our policies will not be approved. We will notify you so you can then change your product to then meet our policies.

If we find that your products do not obey our policies, we aren’t going to kick you off, that’s silly. We believe that all that’s needed is a little help and guidance, and we are more than happy to give you a helping hand here.

 

 

 

 

Deliveries:

-Provide an accurate "dispatch from" address.

-Specify your postage costs and processing times in your listings.

-Dispatch items promptly after they are sold. Prompt dispatch means that you dispatch each item within 30 days of purchase, unless you specify otherwise in your processing time. Before you update your processing time for a specific order, you must first obtain your buyer’s consent.

-Dispatch to the address listed on the receipt you receive on purchase.

 

 

 

 

Returns:

When using Born-Eco, sellers agree that the buyer has the right to return the item, even if the item is not faulty (this is the consumer’s right in UK law).

If the buyer wishes to return an item they must contact Born-Eco, not the seller. Once the seller has been notified by Born-Eco, and evidence has been given that the item has been returned to the seller, Born-Eco will then make a refund to the customer via PayPal.

The buyer has the right to do this up to 14 days after receiving the items, and a full refund (which includes the cost of the outgoing postage) must be made within 14 days of the seller receiving the returned item(s), or within 14 days of the buying providing evidence that the item(s) have been returned (e.g. proof of postage), whichever is sooner.

Unless the seller has stated otherwise, the buyer is responsible for paying the cost of return postage.

Please note: Unless faulty, the following types of items are non-refundable: items that are personalised, bespoke or made-to-order, items with limited life span (e.g. food), personal items sold with a hygiene seal (cosmetics, underwear), where the seal is broken.

The buyer has a right to return goods if they develop a fault within six months of receipt of the goods. Depending on the circumstance, they may be entitled to a refund (full or partial), a repair or replacement.

 

 

 

 

Prohibited items:

Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs

Animal Products (this includes leather) and Human Remains

Dangerous Items: Hazardous Materials, Recalled Items, and Weapons

Hate Items: Items that Promote, Support, or Glorify Hatred

Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items

Internationally Regulated Items

Pornography and Mature Content

Violent Items: Items that Promote, Support, or Glorify Violence

Non-renewable battery powered electrical equipment (e.g. a single use battery)

Single-use/throw away plastic of any kind (see Plastic Policy)

 

 

 

 

Plastic Policy:

Although Born-Eco does not outright ban the use of single-use/throw-away plastic we see it as an opportunity for change. So, a seller who is found or reported to be using such materials in any form will be given a warning. If this warning is ignored and the seller continues to use these prohibited materials an immediate sanction/ban will be issued, until that seller switches to an environmentally friendly alternative. Born-Eco reserves the right to issue a sanction or ban from the site at any time, without notice. This policy also applies for recyclable plastics; this means that even if your packaging/product says it can be recycled it is prohibited from being used on Born-Eco.

Born-Eco allows for products that have been made from existing plastic that would have otherwise been thrown away or let into the environment (for example a product made from litter picked bottle caps or clothing made from existing waste plastic bottles). Born-Eco does not condone nor allow the intent of purchasing items such as bottle caps or plastic bottles to then be turned into other products. (Basically, if bottle caps were to be used to make a certain product they MUST be post-consumed, as in already used and ready to be thrown away, not purchased brand new).

The use of plastic is allowed under certain strict circumstances:

  1. When the product/packaging is reusable, for example a reusable plastic container used to package a product that is returned to the sellers for future use.
  2. If the plastic material adheres to the point above about Post-Consumed Plastic.
  3. A product on Born-Eco that replaces an existing, plastic product in society, is allowed to use plastic packaging. For example, bamboo nappies that replace the normal 'polymer mix and glue' nappies, are allowed to use plastic packaging. This policy applies for any product that replaces the 'plastic' norm. We allow this policy because although the packaging is plastic, this product helps massively reduce the amount of plastic overall, and helps consumers move towards a less wasteful lifestyle.
